Applicability of this Privacy Policy

This Privacy Policy applies to visitors to the Site (“www.grafieks.com”), who view only publicly-available content (the “Visitors”) and subscribers (the “Subscribers”) who have signed up to access and use our product (the “product”) and services.

By visiting our Site, Visitors are agreeing to the terms of this Privacy Policy and the accompanying Terms of Service. By signing up, accessing, and/or using the Platform, each Subscriber is agreeing to the terms of this Privacy Policy and the accompanying Terms of Service (“TOS”).

Changes to this Privacy Policy

Grafieks reserves the right to change this Privacy Policy as needed to reflect its data protection practices or as required by applicable legislation, and by accessing or using the Product and Services, or continuing to access or use the Product and Services, you agree to be bound by any such changes. Please review this Privacy Policy regularly as its terms may change from time to time.

Information We Collect

Contact information:

  • First name, Last name, Email address, Job title, Company name, Country, Phone number (“Contact Information”), user names and passwords.

Billing Information:

  • Name, location, contact details, and billing information.

    Grafieks will not collect financial information from you (such as your payment card number, expiration date or security code). All payments to us are handled via a third party who act as merchant of record (MOR) for Grafieks.

Website data:

  • We may collect online and technical information from your computer or mobile device when you visit a Grafieks website, such as your, browser type; your Internet Protocol (IP) address and geographic areas derived from your IP address; time-stamped logs regarding access times and duration of visits; the web pages you visited before coming to Grafieks websites (referring URL); and other usage data.

Product-related data:

  • When you use a Grafieks product or service, we collect certain information related to your use of our products and services. Grafieks products may collect Product Data. " Product Data" refers to technical information about your computer or mobile device (such as device type, operating system type and version, and Grafieks-assigned identifiers that help us recognize your device and validate that you are a licensed user), and details about which of our products and product versions you are using.

Information collected via Support and Success Channels:

  • We will store the information you supply through our customer support and success channels.

    Whether you designate yourself as a technical contact, open a support ticket, speak directly with one of our representatives, or otherwise engage with our support team, you will be asked to provide contact information, a summary of the problem you are experiencing, and any other documentation, screenshots, or information that would be helpful in resolving the issue.

    From time to time, our support team may temporarily access your workspace for the sole purpose of prompt resolution and fast troubleshooting. All such access attempts are logged internally and associated with a support ticket.

    Information sent to our group emails for support and customer success will be accessible by our engineering and business teams on duty to provide you a more holistic and responsive service level. If any of such data needs to be shared, please indicate in your email communications that such data is sensitive and confidential.

    For the avoidance of doubt, emails sent with generic company confidentiality boilerplates footers at all emails appended by default will not be classified as such sensitive/confidential information unless otherwise stated.

Why We Collect, Store, Use, and Disclose Information
  • To provide you with Grafieks website content, the features, functions and benefits of the Service.

  • To provide and deliver products or services, including software updates.

  • To respond to your requests for information, products, or services.

  • To enforce our terms and conditions or protect our business, partners, or users;

  • To provide you with notices related to your use of the Products and Service.

  • To personalize our website, Services, and Communications to your likely interests and needs

  • To provide service and support, such as sending confirmations, technical notices, updates, security alerts, and administrative messages and providing customer support and troubleshooting;

  • To send you business messages such as those related to Services notifications, payments or renewal of your subscription, or process billing for your Service subscription (i.e. charging your credit card).

  • To provide you with promotional and marketing emails. You can opt-out of receiving certain types of promotional and marketing emails, but if you do you may not receive the full benefit of the Service. Opting-out can be done by following the instructions at the bottom of the promotional material.

  • To contact you via telephone to discuss our Services and related offers with you

  • To personalize the Service experience for you (such as, remembering your information so you will not have to enter it each time you use the Service).

  • To email you periodically (intervals of months) to explore if you like to re-evaluate our Services if you have previously tried us.

  • To keep our products, facilities, and services secure.

From time to time, we may provide information to our customers and potential customers in the form of electronic or print newsletters. When you subscribe to our newsletter you may be added to our mailing list and will receive announcements and information about Grafieks. It will be emailed or mailed to the address that you provide when you subscribe.

Personal Information Sharing

Grafieks will not disclose Personal Information with third parties unless you have given your consent, except as set forth below. In certain circumstances, Grafieks may share certain Personal Information with third-party service providers that need your information to provide the following operational or other support services to Grafieks:

  • Email communications (operational, marketing)

  • Customer Relationship Management

  • Data management

  • Database hosting

  • Payment card processing

  • Helpdesk services

  • Shipping services

  • Collaboration services

  • Cloud services

  • Online Advertisements

We will only share data to third parties without your express consent:

  • If we are obliged to do so by statutory law or an instruction by a public authority or court.

  • To enforce our agreements, policies and Terms of Service.

  • To protect the security or integrity of the Platform.

Cross-border data transfers

Grafieks may transfer Personal Data between the European Union or Switzerland and the US. If you are a resident of the EEA, the UK or Switzerland, we will protect your personal data when it is transferred outside of the EEA, the UK or Switzerland by processing it in a territory which the European Commission has determined provides an adequate level of protection for personal data; or otherwise ensuring appropriate safeguards are in place to protect your personal data. For transfers of your personal data to the US, following the invalidation of the Privacy Shield, we will rely on the Standard Contractual Clauses approved by the European Commission.

Subprocessors

We use a select number of trusted external service providers for certain technical data processing and/or service offerings. These service providers are carefully selected and meet high data protection and security standards. We only share information with them that is required for the services offered and we contractually bind them to keep any information we share with them as confidential and to process Personal Data only according to our instructions.

How Long Do We Retain Your Personal Information?

We will retain personal information for as long as it is needed for legitimate business purposes, to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. We keep such servers to help protect the stability and availability of the Service (such as protecting it from viruses and malfunctions).

To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorised use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements.

Some of your Personal Information may also remain on backup systems or third-party services after your use of our websites and/or Services ends, unless you request that your data be deleted.

Your rights

European data protection laws give you certain rights regarding your personal information. You may ask us to take the following actions in relation to your personal information that we hold:

You can submit these requests by email to privacy@grafieks.com. We may request specific information from you to help us confirm your identity and process your request. Applicable law may require or permit us to decline your request. If we decline your request, we will tell you why, subject to legal restrictions. If you would like to submit a complaint about our use of your personal information or response to your requests regarding your personal information, you may contact us as described above or submit a complaint to the data protection regulator in your jurisdiction. Minimum Age

The Site is not directed to, nor intended to be used by, individuals under the age of 16. Grafieks does not knowingly collect personal information from individuals under the age of 16. If you become aware that an individual under the age of 16 has provided us with personal information, please contact us immediately at privacy@grafieks.com. If we become aware that an individual under the age of 16 has provided us with personal information, we will take steps to delete such information.
